Agreement to Terms
These Terms of Service constitute a legally binding agreement between you and PassifyTool regarding access to and use of the website, tools, pages, and related documentation. By accessing or using PassifyTool, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree with any provision, you must discontinue use immediately.
We may revise these Terms periodically to reflect legal requirements, product changes, security practices, or operational updates. Modified terms become effective when posted unless otherwise stated. These Terms apply to all users, including casual visitors, developers, security professionals, and enterprise teams using or referencing PassifyTool in internal or external workflows.
Intellectual Property Rights
Unless otherwise indicated, the PassifyTool website, design, layout, trademarks, logos, copy, and software components are owned by or licensed to PassifyTool and are protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, revocable license to access and use the service for lawful personal or commercial purposes. This license does not transfer ownership of any intellectual property rights.
You may not reproduce, distribute, sell, lease, reverse engineer, or create derivative works from protected platform elements except as expressly allowed by law or written permission. Brand features, names, and logos may not be used in a way that implies sponsorship, endorsement, or affiliation without prior authorization. Any unauthorized use may result in termination of access and enforcement of legal remedies.
Acceptable Use & Prohibited Activities
You agree to use PassifyTool only for lawful purposes and in a manner that does not interfere with platform integrity, availability, or security. Prohibited conduct includes attempting unauthorized access, introducing malware, bypassing protective controls, exploiting vulnerabilities outside responsible disclosure channels, and using the service to support unlawful activity. You may not engage in behavior that degrades service performance for others or places disproportionate load on network or application resources.
Automated scraping, indexing, crawling, or bulk extraction of content is prohibited without prior written permission, except where explicitly permitted by applicable law or machine-readable directives. You may not misrepresent identity, submit fraudulent requests, or attempt to harvest data through scripted abuse. We reserve the right to block, suspend, or terminate access for activity that violates these Terms, threatens cybersecurity posture, or creates legal or operational risk.
User Representations
By using PassifyTool, you represent and warrant that: (1) you have legal capacity to enter into these Terms; (2) your use will comply with all applicable local, state, national, and international laws; (3) you will not use the service in connection with unlawful surveillance, credential theft, or unauthorized account access; and (4) you understand that PassifyTool is a utility aid and not a substitute for a complete enterprise security program.
You further represent that any credentials, test strings, or data processed through the service are handled with proper authorization from the relevant owner or administrator. You are solely responsible for decisions made based on tool outputs, including password policy enforcement, hashing selections, and downstream implementation in your environment. PassifyTool does not validate your legal authority over processed material.
Disclaimer of Warranties (Expanded)
PassifyTool is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment. We do not guarantee that service operation will be uninterrupted, error-free, secure, or compatible with every browser, device, policy framework, or enterprise control stack.
Security tooling depends on user implementation context, endpoint hardening, identity governance, and incident response maturity. As a result, no statement on this website should be interpreted as a warranty that use of the platform will prevent breaches, account compromise, or credential misuse. You acknowledge that cryptographic outputs, entropy estimations, and generated passwords are informational and operational aids. We are not responsible for outcomes arising from weak user practices, lost credentials, misconfigured systems, or integration errors in third-party environments.
Limitation of Liability
To the fullest extent permitted by law, PassifyTool, its affiliates, operators, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, business interruption, reputational harm, procurement of substitute services, or cybersecurity incident costs arising out of or related to your use of, or inability to use, the service.
In jurisdictions where limitation of liability is allowed, our aggregate liability for all claims relating to the service will not exceed the greater of one hundred U.S. dollars (USD $100) or the amount paid by you to use PassifyTool during the twelve months preceding the claim. Because PassifyTool is offered at no monetary charge for standard usage, you acknowledge that this limitation reflects a commercially reasonable allocation of risk between parties.
Indemnification
You agree to defend, indemnify, and hold harmless PassifyTool and its affiliates, officers, directors, employees, contractors, and partners from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to: (1) your use or misuse of the service; (2) your breach of these Terms; (3) your violation of law or third-party rights; or (4) content, data, or materials you submit, process, or distribute through your use of the platform.
We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with such defense. This indemnification obligation survives suspension, termination, or expiration of your access to the service and continues to apply to claims based on prior conduct.
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Subject to applicable consumer protection rules, any dispute, claim, or controversy arising from or relating to these Terms or the service shall be resolved through good-faith negotiation first. If negotiation does not resolve the matter, disputes may be submitted to binding arbitration or a court of competent jurisdiction located in San Francisco County, California, as permitted by law.
You agree that claims must be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative action unless prohibited by law. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right is not a waiver of that right.
